Key Takeaways

  • ✓ A Spanish power of attorney (poder notarial) lets a named person sign the deed for you. Completion can happen with you anywhere in the world.
  • ✓ Three ways to grant one: at a Spanish notary, at a Spanish consulate abroad, or at your own notary at home plus an apostille and sworn translation.
  • ✓ Grant a special power limited to one named purchase, not a general one. Narrow is safe; broad is a liability.
  • ✓ Give it to your independent lawyer. Never to the seller, the developer, or anyone connected to either side of the deal.
  • ✓ It does not cover everything: if you are taking a Spanish mortgage, expect to attend the notary in person for the pre-contract information meeting.

Most of our buyers view in person and then discover the calendar is the problem: completion lands in a working week they cannot take off, or the developer's date moves twice, or a flight is not worth it for a forty-minute appointment. A Spanish poder notarial solves that. You name someone to sign on your behalf, they attend the notary, and the property is yours without you leaving home. It is entirely normal here and it is used on a large share of foreign purchases.

Two decisions matter more than the mechanics: who holds it, and how narrowly it is drawn.

The three ways to grant one

RouteWhat you needSpeedRelative cost
At a Spanish notary, while you are herePassport and NIE. An interpreter if you do not speak SpanishSame day, usually under an hourCheapest. Notary tariff only
At a Spanish consulate in your countryPassport, NIE, an appointmentDepends entirely on appointment availabilityLow. No apostille or translation needed
At your own notary at homeLocal notarisation, then an Apostille of the Hague Convention, then a sworn translation into SpanishSlowest: several steps, each with its own queueHighest. Three separate fees

If you are already coming out for a viewing, do it then. It takes less time than lunch and costs a fraction of the alternatives, and it is the single most useful hour you can spend on a viewing trip. Bring your NIE. You will need one anyway, and the NIE guide explains how to get it.

The consulate route is the usual fallback for buyers who have already gone home. It produces a document in Spanish that needs no apostille and no translation. The constraint is purely appointment availability, so start early.

The home-notary route works and is sometimes the only option, but every added step is another fee and another week. The apostille is the certification that makes a foreign notarised document recognisable in Spain; the sworn translation (traducción jurada) must be done by an officially appointed translator, not any translator.

Special, not general

A poder general lets the holder do almost anything in your name: sell property, take loans, operate accounts. There are situations where that is appropriate. Buying a holiday home is not one of them.

Ask for a poder especial drafted for one named transaction, listing exactly what the holder may do. A sensible list for a purchase:

  • Apply for and collect your NIE.
  • Sign the arras or private purchase contract for the specific property, at or below a stated maximum price.
  • Sign the public deed of sale (escritura) at the notary.
  • Pay the purchase taxes and file the returns.
  • Register the property in your name at the land registry.
  • Open a Spanish bank account and set up the direct debits.
  • Contract the utilities and register with the community of owners.

Note the price ceiling. Naming the property and capping the price means the power cannot be used for anything else, and cannot be used to agree a higher figure than you sanctioned. If you are borrowing, mortgage powers should be a separate, explicit item rather than something bundled in, and see the limitation below.

Who should hold it

Your independent lawyer. Not the estate agent, not the developer, not the seller's lawyer, not a family friend of the vendor, and not us. This is the one place in the process where a conflict of interest could be genuinely costly, because the holder is signing binding documents in your name.

If anyone in the transaction suggests that they hold the power to "make it simpler", treat that as a significant warning sign and decline. It is not simpler. It is the arrangement that appears in the worst stories, and it belongs alongside the other patterns in Spanish property scams and 12 pitfalls of buying property in Spain.

What can and cannot be done remotely

StepRemote?Note
NIE applicationYesVia your consulate, or by your lawyer under the power
Viewing the propertyPartlyVideo viewings work for shortlisting. We would not buy on one alone
Arras or purchase contractYesSigned by your attorney under the power
Opening a bank accountSometimesSome banks accept video identification, others want you in a branch
Transferring the fundsYesBut verify account details by voice, never from an email alone
Signing the escritura at the notaryYesThis is the core purpose of the power of attorney
Mortgage pre-contract notary meetingUsually notSpanish mortgage law requires the borrower to meet the notary personally. Check with your lender
Collecting keys and utilities changeoverYesHandled by your lawyer or agent

That mortgage row is the important exception. Since the Spanish mortgage law reform, a borrower must attend a notary before signing to receive the pre-contractual information and have their understanding recorded. Lenders and notaries generally will not accept a representative for that step. If you are financing the purchase, plan on one trip, or confirm the position with your specific lender early. Mortgages in Spain for foreign buyers covers the wider process.

Cost, validity and revoking it

A Spanish notary's fee for a power of attorney follows a state tariff and is modest in the context of a property purchase. You will receive an authorised copy (copia autorizada), which is the document your attorney presents; keep a record of who holds it.

A power of attorney does not usually expire on its own unless it says so, which is a good reason to include an end date: for example, three months after the expected completion. When it is no longer needed, revoke it formally before a notary (revocación) and make sure the holder is notified and the original copy is recovered. Do not simply assume it has lapsed because the purchase is finished.

What our remote buyers are actually buying

Four live properties of the kind that regularly complete without the buyer in the country: new-build units where the completion date is set by the developer, and apartments bought after a viewing trip earlier in the year.

How we would sequence it

Come out once, view properly, appoint your lawyer, and grant the power of attorney at a Spanish notary before you fly home. That single trip covers the viewing, the NIE, the bank and the power, and everything after it can happen by email. What you should not do is grant a broad power to someone you have never met in order to avoid the trip entirely.

The full purchase sequence is in the complete guide to buying property in Spain, the contract stage is in the arras contract guide, and the money you need on the day is in the true cost of buying property in Spain.

Tell us your budget and the weeks you can realistically be here below, and we will build the trip around what is actually worth viewing.
